Terms of Use and Sale
Internet Diffusion Sàrl — version of 18 October 2026
1. Publisher and purpose
AfterMyLife (the "Service") is published by Internet Diffusion Sàrl, Rue Baylon 2B, 1227 Carouge, Switzerland (the "Publisher"). Full contact details are given in the legal notice.
The Service allows a person to keep messages, files, information and instructions and to organise their deferred provision to designated persons, after human verification of their death. It does not constitute an estate, will or guaranteed evidentiary custody service.
2. Definitions
"Account Holder": a natural person of legal age who opens and administers their account, chooses the recipients, subscribes to and pays for the subscription. The term "owner" is no longer used.
"Beneficiary": a simple recipient designated by the Account Holder to receive only the Contents assigned to them after verification of the death and human authorisation of transmission. In that capacity alone, they may not report a death through the function reserved for Certifiers.
"Certifier": a recipient designated by the Account Holder, entitled to report their death and to provide verification elements; they also receive the Contents assigned to them. Their report does not establish the death and does not automatically trigger transmission.
"Contents": texts, photos, videos, files, information, documents, instructions and other data recorded by the Account Holder. "Transmission": controlled provision of the assigned Contents, and not an automatic transfer of ownership or rights.
"Subscription": the standard, promotional, Founder, gift or other offer proposed and accepted at the time of subscription.
"Sensitive Contents": any content (photos, videos, recordings or texts) that may shock, hurt or offend certain audiences, in particular because of scenes of nudity, violence, blood or disturbing statements.
3. Acceptance, eligibility and account creation
Creating an Account Holder account and acting as a Certifier are reserved for persons of legal age. A minor may be designated as a Beneficiary; access to the Contents intended for them depends on the authentication mechanisms and, where necessary, on legal representation, as well as on the applicable law. The designation does not exempt anyone from protecting the minor's interests and data. Any future family offers will be subject to specific rules when they become available.
Acceptance of the Terms is obtained by means of an affirmative action when the account is created or the order is placed. The accepted version, its date and, where relevant, the technical elements of proof are kept in accordance with the privacy policy.
Separate declaration relating to Sensitive Contents: where processing is legally based on explicit consent, the Account Holder must express this choice by means of a dedicated box, not pre-ticked and separate from the acceptance of these Terms. The choice covers the deposit, storage and post-mortem provision of the Sensitive Contents they decide to entrust to the Service, according to the defined settings. It does not exempt the Account Holder from respecting the rights of third parties mentioned in the Contents. The Publisher keeps proportionate proof of the declaration and of any withdrawal in accordance with the Privacy Policy.
The Account Holder must provide accurate and up-to-date information, secure their credentials, not share their access and promptly report any suspected compromise. The access of Beneficiaries and Certifiers, where it exists, is personal.
4. Operation and designation of third parties
Depending on the offer, the Account Holder may deposit and modify Contents, assign them to recipients, designate Certifiers (recipients who may report a death) and Beneficiaries (simple recipients) and manage their contact details. The applicable quotas and functions are those presented at the time of the order.
The Account Holder is responsible for the accuracy of the identities, addresses and assignments they enter, it being specified that the platform does not verify the identity of the Certifiers and Beneficiaries designated by the Account Holder. The designation of Certifiers and Beneficiaries is subject to their acceptance and creates no immediate or irrevocable right of access. It may be modified by the Account Holder as long as the Service allows it and no security measure or death procedure prevents it.
The Account Holder warrants that they hold the necessary rights to the Contents and that they respect the rights of third parties, confidentiality obligations and the rules applicable to credentials of external services. AfterMyLife does not guarantee that a third party will be able to lawfully use a transmitted identifier, password or external account of any kind.
Role-related notifications: upon their designation, Certifiers and Beneficiaries may receive a message specifying their role. An annual reminder is sent to them as long as their role remains active, to recall the designation by the Account Holder and the steps to take on the platform in the event of death. Certifiers have the reporting function provided by the Service; simple Beneficiaries may not use this function. The Account Holder receives reminders to check and update their Contents, as well as notifications when their account remains empty. Death and provision notifications follow Articles 7 and 8. Messages necessary for the operation of the roles are not promotional communications and cannot be disabled simply by unsubscribing from the newsletter; a person concerned may contact the Publisher to contest their designation or have it ended, within the applicable limits.
5. Offers, prices, payment and renewal
The characteristics, quotas, prices, taxes and currencies (in particular CHF or EUR) are those displayed at the time of subscription. The prices and benefits of Founder, promotional or free offers are personal, non-redeemable for cash and non-cumulative unless otherwise stated.
Unless explicitly stipulated otherwise in the accepted offer, paid subscriptions are invoiced in advance and automatically renewed for an equivalent period, until termination. The renewal price and any substantial change are announced in advance under the conditions and within the time limits required by law.
Payments are processed in particular by Stripe. AfterMyLife does not receive the full card number. The Account Holder may disable renewal before the due date through the available functions or via support. Termination takes effect at the end of the paid period, subject to applicable mandatory law.
Proof of the renewal choice and of the acceptance of the applicable terms is kept with the date, time, contractual version and IP address where such collection is justified, necessary and proportionate.
6. Payment default: delay, suspension, review and information of third parties
6.1. Delay: in the absence of payment on the due date, the account remains active for thirty (30) days. Reminders are sent to the Account Holder only, by e-mail and/or in the application. A payment default never constitutes a report or presumption of death.
6.2. Suspension: at the end of these 30 days, the account is suspended for ninety (90) days. The Account Holder may view and export their data, but may no longer modify it. Certifiers may no longer file a new report through the ordinary functions of the account. The Service may keep a separate contact channel allowing the Publisher to be informed of a death.
6.3. Neutral notification: at the start of the suspension, a message may be sent to the designated Beneficiaries and Certifiers: "The role that [first name] had entrusted to you on AfterMyLife has ended. No action is required on your part." It reveals neither the non-payment, nor the Account Holder's personal situation, nor any assumption of death. Sending is enabled by default and the Account Holder may disable it in their profile.
6.4. Reactivation: during the suspension, the Account Holder may request reactivation by taking out a new subscription. No additional administrative reactivation fee is charged. Reactivation is carried out subject to payment and security checks and to any ongoing death procedures or legal measures.
6.5. Invitation to export: thirty (30) days before the end of the 90-day suspension, the Account Holder receives, as far as possible, a reminder inviting them to export their data.
6.6. End of suspension: at the end of the 90 days, the account is placed in the administrative status "Under review". No deletion is triggered automatically. An authorised administrator reviews the situation, payments, reports, any disputes and retention obligations. If they decide on deletion, it is carried out within a target period of thirty (30) days after the review, subject to verifications, legal obligations and technical constraints. The 30-day period mentioned above is purely indicative. Erasing the data requires a manual procedure whose execution time may vary and is not guaranteed.
6.7. Death: a death reported and verified during the delay, the suspension or the review is handled according to the death procedure, regardless of the billing status, as long as the Contents exist and can be lawfully transmitted. A payment default never triggers an automatic transmission.
7. Verification of death and transmission decision
Receipt of a certificate, a death notice, a report by a Certifier, a family message or any other document never automatically triggers transmission. Any opening of access is preceded by a check and an explicit decision by an authorised member of the AfterMyLife team.
The Publisher reasonably assesses a body of consistent evidence, which may include official deeds or certificates, verification of their apparent authenticity, independent information and, where necessary, additional checks. The list and weighting of the evidence are determined by internal procedures adapted to the risks.
Verification with the Account Holder: when a death is reported and the circumstances justify it, the Publisher may attempt to contact the Account Holder directly using the recorded contact details and channels, or carry out other independent checks, before any transmission. A lack of response never constitutes, on its own, proof of death. Contact is made with caution in order to limit the risks of fraud, identity theft and undue disclosure.
In the event of doubt, dispute, suspected fraud, uncertain identity, documentary contradiction, injunction or risk of abusive disclosure, the Publisher may suspend, defer or refuse transmission until clarification, documenting the decision. It may request additional supporting documents and verify the identity of the recipients.
Objections and conflicting claims: where heirs, successors, recipients or other persons with a legitimate interest make incompatible requests, the Publisher may freeze all or part of the procedure and of the access concerned, including after an initial decision, for the time reasonably necessary for clarification. It may request supporting documents, a written agreement of the legally entitled persons or a decision of a competent authority, without being required to arbitrate an inheritance dispute itself. Unanimity of all heirs is not required where the applicable law or an enforceable decision allows otherwise. Any measure remains proportionate and documented.
Human decision does not exclude residual error. The Publisher applies due diligence proportionate to the sensitivity of the Contents and keeps a record of checks, decisions, persons involved and provisions, within legal limits.
8. Transmission, access of Beneficiaries and duration
After verification of the death and manual authorisation, Certifiers and Beneficiaries, together the "recipients", may access only the Contents assigned to them, according to the Account Holder's settings, the verified identity and rights of the recipients and legal requirements.
From the confirmation of the death and the corresponding opening of access, the assigned Contents remain accessible to the recipients for twelve (12) months. Monthly reminders are sent to the recipients concerned. Fourteen (14) days before the end of this period, recipients who have not retrieved all their Contents receive a final warning of closure of access. Reminders constitute an obligation of means, subject to valid contact details and the functioning of electronic communications.
At the end of the twelve (12) months, access is closed and the Contents are kept for three (3) additional months. During this period, an authorised administrator may reopen access for a fixed period, with automatic notification of the recipients concerned. Any reopening must be compatible with the purge date: a reopening beyond the planned deadline requires the explicit and traceable postponement of that deadline, within legal and technical limits.
At the end of the fifteen (15) months following confirmation of the death, the data of the deceased Account Holder's account (in particular files, messages, contacts, subscription and account) are automatically and permanently deleted, subject to legal retention obligations, a legally justified preservation measure or an explicit and traceable postponement linked to a reopening. The personal accounts of the recipients are not deleted. Only an anonymised audit record remains, indicating in particular the dates of confirmation of death and of purge, provided that it no longer allows a person to be identified. The end-of-access and purge dates are displayed in the administration; the duration settings may be modified by authorised persons within contractual and legal limits. This post-death schedule is distinct from suspension for non-payment.
Future features: multi-year prepayment or memorial site options, public or reserved for recipients, are envisaged but are not part of the contractually promised Service until they are actually offered. Their availability, prices, refund terms and rights to maintain the memorial site will, where applicable, be defined by special conditions accepted before activation. No general waiver of mandatory refund rights results from this mention.
9. Nature of the Service and absence of automatic inheritance effect
AfterMyLife is exclusively a technical service for the storage and deferred provision of digital Contents according to the Account Holder's settings and after human verification of the death. The Publisher does not act as a notary, lawyer, legal or tax adviser, executor, estate administrator, official custodian, fiduciary, or as an authority responsible for determining heirs or their rights. It does not draft, authenticate, register or validate inheritance documents and guarantees no evidentiary, testamentary or enforceable value of the Contents or of the designations made in the Service.
The designation of a Certifier or a Beneficiary, the deposit of a message, a password or an instruction, and the technical transmission of Contents do not, on their own, constitute a will, a bequest, a post-mortem mandate, an advance directive, a gift, an allocation of inheritance rights or an authorisation of access enforceable against third parties. They do not alter the legal rules relating to heirs, the reserved portion, confidentiality, protected secrets, intellectual property rights or the terms of third-party services. The Account Holder must obtain the advice and complete the formalities required from the competent professionals. In the event of a serious dispute or a decision by a competent authority, the Publisher may suspend or adapt the transmission in accordance with Article 7, subject to its legal obligations. The Service does not guarantee that a recipient will be able to exercise a right of access or use over a third-party account or service solely because an identifier has been transmitted to them.
10. Security, incidents and technical limits
AfterMyLife implements technical and organisational measures appropriate to the risk, which may include encryption, access controls, logging, backups, privilege limitation, security checks and incident response procedures. The announced measures must correspond to the measures actually deployed.
No computer system can guarantee absolute security or availability. The Service may be affected by cyberattacks, ransomware, unauthorised access, human error, failures of networks, providers, hosts, equipment, software or backups.
In the event of an incident, the Publisher may temporarily block access, modifications, downloads or transmissions to limit risks, conduct investigations, restore systems or comply with a legal obligation. It takes the notification measures required by the applicable law.
The Account Holder is invited to keep an independent copy of irreplaceable Contents. AfterMyLife is not a substitute for a permanent personal archiving or backup system.
11. Liability and limitations
AfterMyLife is bound by the duty of care and security obligations imposed by the applicable law and by an obligation of means for services that are not covered by an express guarantee of results.
To the extent permitted by law, the Publisher is not liable for consequences directly attributable to false or outdated information provided by the Account Holder, to access compromised through a user's actions, to unlawful uses of Contents, to decisions of authorities, to acts of third parties beyond its control or to circumstances of force majeure.
AfterMyLife is not liable for the contents uploaded by the Account Holder and/or the information associated with those contents, which are the sole responsibility of the Account Holder and of the designated persons entitled to access. AfterMyLife does not access the contents and does not check their content.
Transmission errors or delays, cyberattacks and technical failures are not automatically exonerating: liability is assessed in particular in the light of the reasonably expected diligence and of mandatory obligations. No clause limits liability for wilful misconduct, gross negligence or any other liability that cannot legally be excluded.
To the extent legally permissible, for direct and foreseeable contractual damage, the Publisher's aggregate liability is capped at the amounts actually paid for the account concerned during the twelve (12) months preceding the event. This limitation does not apply where it is prohibited by a mandatory rule, in particular in matters of data protection or consumer rights.
In the event of a conflict, objection, injunction or claim between heirs, successors, Certifiers, Beneficiaries or other third parties, the Publisher may, as a precautionary measure, freeze access and transmission, preserve useful elements and request a sufficiently clear written agreement of the legally entitled persons or a decision of a competent authority. To the extent permitted by mandatory law, the Publisher is not liable for delays or impossibility of transmission resulting from these reasonable precautionary measures or from conflicting requests not attributable to it. This clause excludes neither its own fault nor its legal obligations.
12. Availability, evolution and support
The Publisher aims for reasonable availability without guaranteeing uninterrupted operation. Interruptions may result from maintenance, updates, incidents, security requirements or external providers.
Future features, in particular memorial services, artificial intelligence tools, applications or add-on modules, do not constitute a delivery commitment without an express contractual promise. Substantial changes are communicated in accordance with the applicable law.
13. Termination, deletion and retention
The Account Holder may terminate renewal for the future. Refunds and any rights of withdrawal depend on the mandatory provisions applicable in the consumer's country and on the pre-contractual information provided. No general advance waiver of mandatory rights is provided for.
Deletion of the Contents follows the applicable contractual cycle: non-payment procedure (Article 6), transmission after death (Article 8) or a valid deletion request. A deletion decision does not necessarily erase all backup copies instantly; these follow their purge cycles and legal obligations.
Accounting documents, proofs of consent, security logs and death supporting documents may be kept separately from the Contents, for the necessary and justified periods indicated in the privacy policy.
14. Intellectual property, subcontracting and assignment
The Service, its interfaces, trademarks, software and protected elements belong to the Publisher or its successors in title. The Account Holder retains their rights to their Contents and grants the Publisher the technical rights strictly necessary for the performance of the Service.
The Publisher may use technical providers and transfer its business under the conditions of the applicable law, subject to maintaining the required contractual and data protection guarantees.
15. Evidence, communications and amendments
Electronic confirmations, versions of the Terms, acceptance histories, technical logs and transmission records may be produced as evidence, subject to their reliability and to legal rules.
Proof of the separate acceptance relating to Sensitive Contents includes, according to legal and technical needs, the version of the declaration, the date and time, the account concerned and proportionate technical elements; any withdrawal or modification is logged.
Communications relating to the account, security, renewals and transmission may be made electronically. Substantial amendments to the Terms are announced with the notice and options required by the applicable law.
Operational notifications: upon their designation, Certifiers and Beneficiaries may be informed of their role and of the steps to take in the event of the Account Holder's death. As long as their role remains active, an annual reminder may be sent to them to recall their designation, their role and the need to log in to the platform when a death must be reported or access is opened. The Account Holder periodically receives invitations to check and update their Contents, as well as reminders when their account remains empty. Notifications relating to reports, verifications and transmissions after death follow Articles 7 and 8. These operational messages, distinct from commercial communications, are not subject to marketing unsubscription as long as they are necessary for the role or the operation of the Service; recipients may request verification or termination of their role, subject to the applicable checks. Sending depends in particular on the validity of contact details and the functioning of the means of communication.
16. Applicable law, jurisdiction and contact
The contract is governed by Swiss law, subject to the mandatory protections granted to consumers in their country of residence. Subject to the same reservation, the competent courts of Geneva are designated for contractual disputes.
Legal and personal data contact: legal@aftermylife.net. Support contact: support@aftermylife.net. The possible invalidity of a clause does not affect the other provisions, to the extent permitted by law.
